May 26, 2009- Albuquerque, NM-- If you are owed money by Gil Baca, one of his companies or other
firms who claim that they are getting out of responsibility for debt through Bankruptcy, don't worry. Here is why: (taken from US Bankruptcy Court website- (CLICK HERE FOR MORE INFO)
Generally speaking, the exceptions to discharge apply automatically if the language prescribed by section 523(a) applies. The most common types of nondischargeable debts are certain types of tax claims, debts not set forth by the debtor on the lists and schedules the debtor must file with the court, debts for spousal or child support or alimony, debts for willful and malicious injuries to person or property, debts to governmental units for fines and penalties, debts for most government funded or guaranteed educational loans or benefit overpayments, debts for personal injury caused by the debtor's operation of a motor vehicle while intoxicated, debts owed to certain tax-advantaged retirement plans, and debts for certain condominium or cooperative housing fees.
The types of debts described in sections 523(a)(2), (4) and(6) (obligations affected by fraud or maliciousness) are not automatically excepted from discharge. Creditors must ask the court to determine that these debts are excepted from discharge. In the absence of an affirmative request by the creditor and the granting of the request by the court, the types of debts set out in sections 523(a)(2), (4) and (6) will be discharged.
Gil Baca and Legit Securiy hasn't filed for Bankruptcy anyway. The company, Legit Security Inc., is made up of several stock holders. Bankruptcy would require ALL of these people to file for bankruptcy too. Some of these people have too many assets to file. They will be forced to pay if the creditors can track them and the money owed down.. But who can collect against Gil Baca? Me. I have helped others clear debts and I have purchased judgements against him (obtained by others) and successfully collected to his anger and amazement.

My advice to those who are owed money is to collect it. People claim Bankruptcy, or even file for it to try to get creditors off of their backs. To proceed with a real Bankruptcy, a debtor must SWEAR to their bankruptcy schedules. All files become public and a Trustee is appointed. Don't think for a minute that I will sit idly by while anyone tries to lie on a Bankruptcy, that is a Federal Offense...
I'm not going away anytime soon and I check all available databases daily for new information. Crooks beware.
