A Cease And Desist? Really?

December 14, 2010- Albuquerque, NM (of course)- I received a letter from an attorney asking me to cease publishing defamatory, slanderous or false statements and communicating the same to individuals.  Let me first say that this guy sounds really nice and I don't know that he has any idea of the people he is dealing with (his client). That being said, I have not said anything that is intentionally false, slanderous or defamatory.  Some of the things that we uncover are unsavory but that is not of my doing.  I report the facts.

Apparently this attorney doesn't know that all of the things that I listed are truths and verified..

TRUE

• Reported Nick P. and his company to various state. local and Federal Agencies
• His company is in violation of several if not many laws
• Most of his employees were good people who just needed a job
• He stole from them, didn't pay their employment taxes, Medicare or Worker's Compensation
• He has a licensed security company
• His guard was arrested on duty for firing his handgun at innocent people and booked for felonies
• He didn't report this occurrence to the NM PI Board as required by law
• He bailed him out of jail
• His employee Scott Rogers was injured on the job and had no WC insurance to cover his injury
• I spoke to people who are employed and have been his employment
• They gave detailed statements to me and the authorities
• At this point I feel like I have talked to all of Nick's employees (opinion- don't know all of the past ones yet..)
• He employes unlicensed security guards
• He Employed Joe Cook, Chris Perine
• Joe Cook is on Federal Unemployment and Nick paid him under the table in cash
• Joe Cook has no guard license and worked illegally
• Nick paid Perine in cash under the table
• Oh, Nick pays everyone under the table and in cash..
• Chris Perine has several police reports filed where he is listed as a security guard and a suspect
• I was unaware of this fact prior to doing a police report search (and he as a license)
• NM Child Support Enforcement said that Perine was evading his support
• Nick has no employee files and has never withheld taxes from any pay
• Nick made all employees sign "volunteer" statements, falsely that they were working for free
• Nick P. and his company do not pay gross receipts tax.  I spoke to one fraud investigator who said she spoke to him personally in July.  He admitted to having never paid sales tax but withheld it from customers.  He has never paid it to date. He is being investigated criminally for this offense.
• Chris Perine dropped off a copy of Nick's client list a few weeks ago at my office
• Two people witnessed this and spoke to him (his actions were unsolicited)
• I offered, repeatedly to Nick to send this list back to him or let him talk to my employees
• Nick P is on SSI Disability
• Nick P does not report the significant income from his company to SSI
• or his US Income tax
• or his NM Income tax
• Nick P is illegally running his company office from 12999 Central and has no zoning permit
• It was stated to me that certain employees of Nick's have knowingly stolen items from the hotel
• As of the writing, 7 people worked for Nick including him
• Nick had around 10 ex-employees
• Philip Glock is an employee of Nick P.
• He was arrested for Negligent use of a Deadly Weapon and Aggravated Assault against his girlfriend in Santa Fe and it was reported in the news  He has no guard license but continues to work illegally
• Nick P. has a outstanding civil judgement for $13,000 +/-
• I contacted the attorney handling this case and gave him truthful information regarding Nick's assets and income
• NM Worker's Compensation Compliance Bureau stated that Nick told them that they company only had 2 employees and he wasn't required to have WC insurance.  This is untrue and WC has done their own investigation into his affairs that contradicted his statements. I spoke to this agency at length and provided them with several people to contact. 
• I am now a witness for the state of New Mexico in several pending proceedings
• I have evidence well documented..

I knew something was funny about Perine. I just couldn't prove anything myself. I got canned for not being available 24/7 because I had to take care of my grandmother during the days and asked for graveyards.

Nick Panagoucoulousss is a prick. He has always been a wannabe PRIVATE LAW ENFORCEMENT OFFICER joke. He has no pull with anyone and everyone knows it. Looossserrrr. I hope he gets what he has coming and quick..
