Albuquerque, NM- March 25, 2009-- A new NM case was decided upholding rights of internet content providers and bloggers recently. Of course there is a ton of law out there and OF COURSE truth is an absolute defense to anyone making an accusation of slander or libel. Some people have always wanted to stop the New Mexico Security Blog or publish "opinion" blogs with no supporting facts or information to confuse the public and or industry employees. Obviously, it hasn't worked...
Security employees have always been apprehensive to contact me or others responsible for this blog because they felt that that their employer might fire and or sue them when they provided information about illegal or unethical activities of some of New Mexico's worst companies. Eventually, we have been contacted by these people and provided with much information... This information has helpful and it has made an impact. Please continue to contact us and send the information that is in your control.

OPINION
BUSTAMANTE, Judge.
{1} Angela V. Woodhull, Ph.D. (Plaintiff), acting pro
se, appeals the trial court's grant of summary judgment in
favor of Carolyn Meinel (Defendant). The trial court
ruled that the applicable New Mexico statute of
limitations and 47 U.S.C. § 230 (1998), the
Communications Decency Act of 1996 (CDA), both bar
Plaintiff's defamation claim. Plaintiff's appeal presents
the first opportunity for this Court to consider the statute
of limitations and CDA as they relate to Internet-based
defamation claims in New Mexico. We reverse the trial
court's grant of summary judgment and remand.
{2} Plaintiff also appeals the trial court's decision on
three other matters, including denial of her motion for
summary judgment, denial of her motion to sanction
defense counsel, and denial of her motion to amend her
civil complaint. Defendant argues that, while her motion
for summary judgment on the statute of limitations and
CDA was properly granted, her motion for summary
judgment on grounds that Plaintiff is not the real party in
interest was improperly denied. We do not consider any
of these matters because of procedural issues.
BACKGROUND
{3} Defendant operates the website
http://www.happyhacker.org. Plaintiff's defamation claim
is based on two instances of Defendant's posting
comments on her website about or relating to Plaintiff in
a section entitled "It Sucks to Be Me." On October 14,
2003, Defendant posted an email message from Plaintiff
entitled "Please contact me" and stating "I have a job for
you." Just below the email message Defendant posted her
own comments. Specifically, she stated that upon calling,
Plaintiff knowingly solicited her to commit a federal
crime by offering her the job of "breaking into a news
web site that had written something unflattering about
her."
CONCLUSION {31} For the foregoing reasons, we reverse the trial court's grant of summary judgment in favor of Defendant on the statute of limitations and the CDA and remand for further proceedings consistent with this opinion. {32} IT IS SO ORDERED. MICHAEL D. BUSTAMANTE, Judge

Albuquerque, NM-- March 20, 2009-- Legit Security manager arrested of carrying a firearm while intoxicated, Nathan Cox "AKA Baby Boy", sets his Myspace.com page to "private" after this blog posted his links... There was an interesting comment by Matt Hibben about him denying smoking "weed with Nathan Cox." I found an interesting comment by a girl that seems to know Nathan Cox and offered to share some "weed" in February 2009. He has now posted a different motto:

Just Wondering.....
A charge of DWI will be enhanced to an aggravated DWI under the following circumstances:
1. You refused to submit to a breath or blood test after being requested to do so by a law enforcement officer;
2. You submitted to a breath or blood test and the results were higher than a .16.
3. You were involved in a DWI accident involving serious physical injuries.
The effect of an aggravated DWI charge is that it enhances the potential penalty that the court may impose after a conviction or plea, and typically involves a period of mandatory incarceration. For example, while a straight DWI first offense carries no mandatory jail time, a first offense aggravated charge carries a mandatory 48 hours incarceration.
An aggravated DWI based upon a refusal will also increase your period of license revocation in an MVD proceeding from 6 months to one year. At this time, an aggravated charged based upon breath score or injuries does not increase your period of revocation in the MVD proceedings.

STALKING IN NEW MEXICO
•
Nearly one in four women and one in fourteen men are stalked at least once in
their
lifetime
in the State of New Mexico.
•
While New Mexico law enforcement reported 162 incidents in 2007, the 2003
New
Mexico
Victimization Survey reported 17,177
individuals had been stalked a total of
245,631
times, an average of 14.3 times per year. As of December 2008, 50 Santa Fe
individuals
reported being stalked.
•
34% of stalking victims reported to law enforcement.
•
83% of stalkers are male.
•
44% of stalking victims were injured by their stalker.
•
26% of stalking victims filed an Order for Protection. In more than half of
these cases
(51%)
the PO was violated.
•
Only 5.5% of stalking crimes resulted in an arrest.
•
In 1 out of 17 cases charges were filed.
•
In 13% of cases, charges were dropped.
•
51% of defendants pled guilty.
•
54% of disposed stalking cases resulted in conviction.
•
In 31% of stalking cases, a weapon was involved, especially if the victim was
another
male.
•
Courts take stalking of males by males more seriously than stalking of females.
Males
who
stalk males were less likely to be acquitted and received longer sentences by 2
years.
•
There are 5.5% fewer arrests for stalkers than for perpetrators of domestic
violence.
•
50% of victims of domestic violence and stalking are also victims of sexual
assault.
•
Stalking behaviors begin in adolescence at twice the rate of dating violence.

30-3A-3. Stalking; penalties. 1997.
A. Stalking consists of a person knowingly pursuing
a pattern of conduct that would cause a reasonable person to feel frightened,
intimidated or threatened. The alleged stalker must intend to place another
person in reasonable apprehension of death, bodily harm, sexual assault,
confinement or restraint or the alleged stalker must intend to cause a
reasonable person to fear for his safety or the safety of a household member.
In furtherance of the stalking, the alleged stalker must commit one or more of
the following acts on more than one occasion:
(1) following another person, in a place other than
the residence of the alleged stalker;
(2) placing another person under
surveillance by being present outside that person's residence, school,
workplace or motor vehicle or any other place frequented by that person, other
than the residence of the alleged stalker; or
(3) harassing another person.
B. As used in this section, "household
member" means a spouse, former spouse, family member, including a
relative, parent, present or former step-parent, present or former in-law,
child or co-parent of a child, or a person with whom the victim has had a
continuing personal relationship. Cohabitation is not necessary to be deemed a
household member for the purposes of this section.
C. Whoever commits stalking is guilty of a
misdemeanor. Upon a second or subsequent conviction, the offender is guilty of
a fourth degree felony.
D. In addition to any punishment provided pursuant
to the provisions of this section, the court shall order a person convicted of
stalking to participate in and complete a program of professional counseling at
his own expense.
A. Harassment consists of knowingly pursuing a
pattern of conduct that is intended to annoy, seriously alarm or terrorize
another person and that serves no lawful purpose. The conduct must be such that
it would cause a reasonable person to suffer substantial emotional distress.
B. Whoever commits harassment is guilty of a
misdemeanor

Bellevue, NE Mar 14 2009 - A wild attempted bank robbery in Bellevue Friday afternoon left a security officer injured and Tased while others are still scratching their heads.
Two men with attempted to rob the First National Bank on Pratt Avenue near Highway 75 and Cornhusker according to police but failed in their plan.
The strange robbery started as a burglary into the bank at around 7a.m. Friday morning. A worker at a nearby business saw two men bash a window at the bank and climb inside. The witness quickly called 911. Once inside the bank, the men attacked a security officer. Police say that the men hit him on the head with a stun gun then used a taser on him. They also pulled a handgun and forced a clerk to open the vault.
Police said that numerous officers soon arrived on the scene and immediately gave foot chase to one of the men who had exited the bank. The second suspect was also quickly apprehended and taken into custody. Police say the suspects were identified as 34-year-old Michael McCroy and 33-year-old Shannon Jackson, both of Omaha Nebraska . Police have charged both men with burglary, robbery, felony assault and weapon charges. "The security officer was injured treated at the scene by the Bellvue Volunteer Fire Department according to a police report. He's a little shook up right now," said David Stukenholtz from Bellevue police. Police said the taser used by the suspects on the security officer was real, but the gun was just a toy.

Our customers have been advised we are in court... - They state that they can't locate the civil case where Davis was sued for Extortion among other things.These people give me 24 hours to remove various items from my blog or else... I wonder if they also gave the Sheriff's Department a Cease and Desist letter advising them not to arrest their officers tonight if they are on duty, unlicensed, illegal and armed? Please remember that Mr. Davis had a license until 2005...I HAVE REVIEWED ALL OF THIS INFORMATION, WATCHIED AND LISTENED TO THE NEWS, TALKED TO NM RLD ABOUT HIS LICENSING AND HAD THIS MAN AND HIS EMPLOYEES UNDER SURVEILLANCE FOR WEEKS- I HAVE JUST ONE QUESTION. HOW IN THE HELL DID THIS GUY EVER GET A STATE LICENSE?Everyone in New Mexico should be very scared. There are many more companies out there like this and many more employees that shouldn't be carrying guns in our communities. There are over 200 security companies in New Mexico. How many are licensed? There are over 50,000 private and and company security guards in New Mexico. How many shouldn't be carrying a gun? How will we be protected if New Mexico issues licenses to crooks and doesn't enforce laws against illegal companies? New Mexico is a border state. Homeland Security is at stake and much more.... We need to demand more from New Mexico RLD, licensing, lawmakers and government!

The New Mexico Private Investigators Board is still issuing licenses to criminals who pose as security guards. I have reported over a hundred felons and other undesirable criminals who work in the industry- with or without a license. The Private Investigator's Board hasn't done anything about these people and they are still working...
I spoke Steve Herrera about Thomas M. Trusley, a guard for ASA Security then Five O security then Advanced On-site Protection. Trusley is a wife beater and he has been arrested eight times.Download truesley_arrests.pdfHe has at least three convictions

I knew he was working at the time for Five O Security and had filled out another application to transfer to the company that took over the accounts- Advance On Site Protection. These guys billed themselves as "mainly cops but a highly professional company with well trained and state certified officers." Well, Trusley isn't any of that. He is a sixty year old man that has been in and out of the legal system on a constant basis, by normal standards.
Anyway, I called the Board Administrator, Mr. Steve Herrera and warned him about this guy's criminal record. THE STATE HAD PREVIOUSLY ISSUED HIM 4 LICENSES IN THE PAST so I thought I might want to point out that THIS GUY HAS NO BUSINESS IN THE SECURITY INDUSTRY.Download trusley_5_licenses.pdfMr. Herrera acknowledged that he had received Trusley's application from Advance Onsite Protection but hadn't issued his license because the company wan't yet licensed. He assured me that he would look into the matter.
The state launched its new license verification system today and I verified that Trusley got his license on June 18, 2008.Download truesley_licensed.pdf/ I spoke to Mr. Herrera today and he said that this man didn't have a license. I walked him through I found this information on the state web site and I heard him mutter a cuss word when he saw what I had seen. Who knows what will happen from here. You can bet that Trusely is still working in security and based on prior experiences, will visit a judge again soon.I think that this is something that they tell me to keep me off of this blog and out of the news media. Obviously, I know they don't do anything with my complaints. I was also told that the PI Board has one compliance investigator that "juggles 4 or 5 Boards." It's great that they are taking this problem so seriously. I wonder how long it will before someone gets killed because of the PI Board's negligence? I wish Governor Richardson read my blog.I have come to the opinion that the state of New Mexico and the New Mexico Private Investigator's Board doesn't care about this industry or the safety of New Mexicans. I was told to file a "complaint."

Albuquerque's Legit Security owners may drive expensive cars and live in gated communities but Tom Joles of channel 4 KOB TV in Albuquerque reports (August 2-3, 2008):
In just August 2008, Gil Baca stated that the company had gross revenue of $2.4 million with projected revenue of $8-10 million. Then in recent developments, Bobby Rodriguez (he is the President now!), is asking for $10 million dollars investment money for his company.
We already know that some employees have successfully used the Albuquerque Police Department to collect back wages by taking them to the company office located at 630 Manzano NE. Maybe the newest unpaid employees can try this to get paid.
Personally, I am wondering when these guys are going to get arrested for all of the stuff that they do (and is all in public record). Time will tell...

JOSEPH SEGURA HAS BEEN IN AND OUT OF JAIL FOR MOST OF HIS LIFE. FOR THE PAST MONTH HE'S BEEN WORKING AS A SECURITY GUARD AT POSTS IN SANTA FE AND ALBUQUERQUE. THE PROBLEM: SEGURA IS A CONVICTED MURDERER. NOW SEGURA'S BACK IN JAIL. HE'S ACCUSED OF TRAFFICKING CRACK COCAINE IN A SCHOOL ZONE. PRIVATE INVESITGATOR ROBB HAMMIC IS A LICENSED OPERATOR. "I agree that the public shouldn't have to deal with this, but it is unfortunate that the problem existed long before the current HR Manager or myself got with the company. While you continue to attack these illegitimate or poorly ran companies you do not provide any real insight on how the guards in these companies, who hold very little power in the companies, a way for them to correct the problems. Well guess what? I do think that this guy works for a shady, illegitimate company that is illegal. The law agrees with me and I think they may meet the Attorney General sometime soon, who may also agree with the law. This is the exact reason responsible, qualified people should operate security companies and manage them. You are probably the supervisor of Tom White... You could've supervised him.? You could not hire FELONS. You could make sure that guards that you supervise actually comply with the law and carry licenses or receive training orGO FIND A JOB WORKING FOR AN ETHICAL COMPANY. Can anyone tell me why this industry is so messed up?
