Albuquerque, NM- 2 men sentenced in security guard's death.

This was reported in the Albuquerque Journal:

ALBUQUERQUE, N.M. -- Two men who accepted plea agreements in last year's beating death of a security guard at an Albuquerque car dealership have learned their fate.
Gary Dustin DiBenedetti, 21, was sentenced to four years in prison for aggravated battery, larceny and other charges.
Joshua Sanstistevan, 19, was sentenced to 364 days in the community custody program with credit for 120 days served for larceny, conspiracy and other charges.
The two are among five men accused in the October 2007 death of Susan Schmidt, 51. She was found lying in a pool of blood Sept. 4, 2007, at a car dealership and died 32 days later.
Prosecutors have said DiBenedetti and Sanstistevan played a minor role in the attack.
The attack happened after Schmidt confronted a group of five young men who were stealing rims from a car at the dealership.

There is no new information on the other three men accused of this crime.  Susan Schmidt worked for US Security Associates in Albuquerque and she was providing unarmed security at a location at the time of her murder.

The "L...." word...

I am not giving out anymore "free advertising" for one of "albuquerque's most sued" companies. I do want to point out more unlicensed activity and false advertising by the "L" word... Check their company website to see how they advertise investigative services.

Don't forget that the "L" word isn't licensed as a private investigation company and doesn't have the required state license (again).

Criminal indictments are just around the corner for some of Albuquerque's most reputed security or "investigation" owners... Be careful.

Santa Fe New Mexico Employees- "listen up!"

I have been contacted by many security employees who work in Santa Fe. (this law applies to all employees in Santa Fe- not just security) They tell me that the problems are worse in Santa Fe and there are many laws being broken. There hasn't been much scrutiny in the city different but that is about to change.

Santa Fe has a lot of regulations for business to follow, an increased living wage that must be paid to employees and all of the standard security licensing rules, regulations and laws are still in effect.

I have heard from many employees who work in Santa Fe but aren't paid the minimum wage.  Read below:

The City of Santa Fe Living Wage Ordinance was adopted to establish minimum hourly wage rates.

Who it affects:

· All profit and non-profit businesses with a business license or business registration issued by the City of Santa Fe. (even illegal companies who don't bother to get a business license..)

Compliance:

· Affected businesses are required to pay employees an hourly wage of $9.50 effective January 1, 2006.

· Beginning January 1, 2009, and each year thereafter, the minimum wage shall be adjusted upward by an amount corresponding to the previous year's increase, if any, in the consumer price index for the western region for urban wage earners and clerical workers.

Ordinance Number §28-1 28-1.12 SFCC 1987
· Administrative Enforcement - The city manager, or his/her designee, is authorized, as appropriate and as resources permit, to enforce this ordinance.

· Criminal Penalty - A person violating this ordinance shall be guilty of a misdemeanor and, upon conviction, for each offense may be subject to fines and imprisonment as set forth in Section 1-3 SFCC 1987. A person violating any of the requirements of this ordinance shall be guilty of a separate offense for each day or portion thereof and for each worker or person to which any such violation occurred.

Contact the City Manager if your wages have been stolen or you are not being paid $9.50 per hour (or didn't receive this wage when you previously worked in Santa Fe).

There are no "loop holes..."  If you work or worked for a security company that did business in Santa Fe and you worked there- you are owed the appropriate wage.  It doesn't matter that the company that you work for doesn't have a business license or bases its business out of Santa Fe.  You are owed the correct wage!  It is as simple as that.  Don't forget that there is an increase in wage coming up January 1, 2009!

Don't forget that is also applies to OVERTIME!  Overtime is defined as more than 40 hours worked in a 7 day period and must be paid at time and a half or $14.25 per hour in Santa FE!

Avalanche Protective Services is trying to cover itself...

After the company already deducted a $50 fee out of all guards checks weeks ago and NONE of it's guards received their licenses... This is the information that I got from a source who works for Avalanche Protective Services today. 

 "We had a mass meeting yesterday. All of the guards had to get finger printed and fill out their state paperwork. The only one who didn't have to was Terry White.  Everyone else was not licensed.  There are about 20 of us.  We still have not received any training." ~ source at Avalanche

Complaints to the state and law enforcement are flying out the door!

I am up to 3.5 lbs. of mail so far and that doesn't include the dozens of faxes!  I can feel the urgency on the part of law enforcement changing and they are definitely interested in all of the new documentation that I have received from my sources.

Investigation 101... Some things can't stay "secrets" forever...

There are many ways to gather information  Public records are a good source.  These records are obtainable and are not private. Security guard applications and all that is contained on them is public information.  State contracts and all that is contained on them is public information.  Police reports, indictments, lawsuits, complaints and many other items are public information (if they exist).  I use public information and I have confidential sources.  If a person is breaking the law by working unlicensed- shouldn't the state be able to contact the individual to investigate?  I post evidence.

One blog says, "It is a sad state of affairs when a “reputable blog” knowingly uses an competitor's internal employee phone list (one issued in 2007, by the way) to bash that Security Company concerning their “lack of registered Security Officers."

Why is this sad?  and... Why do you care if they are all former employees?"

New Mexico Law says: (NMSA 16.48.2.17) "On or after July 1, 2007, every individual seeking employment or employed as a level one (2 or 3) security guard shall file an application for registration with the department.  ... prior to being placed on a guard post for the first time as a level one (2 or 3) security guard.."  

This process also includes fingerprinting, FBI Background Checks and other vital screening.  Why wouldn't a company comply with these measures?  Why would Legit Security, Avalanche Security, United Security, Advantage Security, American Security, Solid Steel Security, Advance On-site Protection or many others that I have featured on this blog comply with this law?  Only these companies and their owners know the answer... Will the state of New Mexico ever ask them?   

I have heard more excuses about "why" something happened (or didn't), "how" someone was arrested but not convicted, "that' someone else was really responsible, "why" the police reports were wrong, "that" the case will get thrown out of court or "other" more colorful excuses since I started this blog than I can count.  I know that this is New Mexico but- when will these people take responsibility for their actions?  

Is there more?  Yep.

This blog also says, ".. because he obviously never performed any research to find out if the people on that Legit Security Phone List are even still employed with the company. None of them are, due to a “weeding-out..."

You just admitted unlicensed activity- idiot.

Whoever speaks for Legit Security just proved my point...

This blog says, "However, we must thank you for the free advertising, Robb! Our client list has increased because of your blog's “competitor bashing”!  There you have it! Legits Offical response to Rob Hamics slander and harrasment tactics!"

There you have it.  Legit Security is open for business and seeking "investors."

What percentage of Legit Security's staff is unlicensed? 40%! More criminal guards!

Please take a look at the staff list for Legit Security.  I found that 40% (32 out of 80) of their supervisors and guards were not state licensed.  I found some glaring criminal records... This is not an attack.  It is just the facts... I'm sure that Legit Security would want to keep all of this information buried or hidden from the public- but oh well...

This list may be a good tool for the state, law enforcement or attorneys to follow up with some of these employees...

Ouch!  32 out of 80 employees unlicensed is a high percentage!  But, heck- when the state doesn't check... who cares!

Why would a person not get licensed?  Criminal records are one reason...

If I were the state I would check out the following employees:

• Lance Friedenstein- it looks like he may have a Larceny/shoplifting arrest, possession of marijuana, etc.
• Stacy Lawshea- it looks like she may have arrests for Battery on a Household Member, DWI and seven additional arrests.  
• James Russ- it looks like he has arrests for Harassment on the Telephone, criminal trespass, server's license required, domestic violence, violation of protection order, and three more charges of domestic violence. 
• Angel Terrazas- it looks like he has arrests for battery, batter, failure to appear in court, and another battery.
• Michael Tribble- I will leave this one up to law enforcement. 
• Issac Wardlow- it looks like he has arrests for receiving transferring a stolen vehicle, controlled substance violation, assault with the intent to commit a violent felony, resisting arrest, probation violation, etc. 
• Francisco (Frank) Maldonado- Multiple time violent, convicted felon who has worked at a few security companies now...   

 

THIS JUST IN...  IT SEEMS AS IF LEGIT SECURITY HAS AN EXCLUSIVE CONTRACT TO PROVIDE SECURITY SERVICES TO THE STATE OF NEW MEXICO IN SANTA FE.  COULD THIS BE THE REASON THAT LEGIT IS STILL IN OPERATION?  Pictures and video are forthcoming... 

Who is Roberto (Bobby, Robert) Rodriguez, self-proclaimed President of Legit Security?

I will tell you what I have found on him and show you some surveillance photos later...  I have received a number of e-mails asking for more information on this man and he was identified as the author of one of the bogus security blogs by a Legit Security employee.  I thought it would be a good time to shed some light on things...

Ouch.  I guess scams don't really pay off in the end.  I hear that other former employees of Legit are getting in contact with this attorney to join the fight.  It may be in your best interest to contact this guy if you have been ripped off by Legit, et. al.

I got carried away with these posts and I don't want people to muss this! Look down a couple of blogs.

Times are tough.. They are really tough for some of NM's security illegitimate businesses.

It is hard to stay in business when you are under so much scrutiny for illegal or unethical business practices.  For years new Mexico's illegal, unlicensed or illegitimate security companies have been able to cut corners without much problem.  They have had free rein to treat their employees poorly and replace them at will when the employees quit or weren't paid.  New Mexico's employees are starting to stand up, speak out for what is right and demand better standards.  The companies run by unethical owners are starting to feel the squeeze.  

Their secrets are no longer secrets!

The slow-down in this economy effects all businesses.  Clients pay slower but all of the bills still have to get paid on time, otherwise the vendors disconnect service.  Employees have to get paid on time or they quit, go to the Department of Labor or call the news to complain.  I guess that some of these wronged employees also get attorneys and sue the former employer.... 

I have found a lot of information from some of New Mexico's worst security companies.  I have been provided reams of paper evidence or corruption, criminal activity, deception of client's trust, illegal labor practices, criminals working in security, drug use on duty, unlicensed activity and much more.  

How do you think that I got all of this information?

Slow, consistent, dedicated investigation is my specialty.  I have gained many friends along the way and found many people who were wronged in one way or another.  I learned that there were many more people like me in the world, who wanted to see a change in this industry.  They are frustrated just like me.  I have formed the largest network of security/ investigation employees/ companies who have become my eyes and ears and we are going to change this industry.  Finally...

I am still sorting through the information I have received in the past few days but I will post it soon.
