I listed some complaints that have been raised about the New Mexico Private Investigator's Board and the operation of the Board. Please make any comments at the link below.
1. The Board meetings are listed on the Web site but have been canceled without prior notice.
2. Board meetings are overly vague and the public portion of the meeting lasts on average 10 minutes.
3. Board Member Khalsa always makes the motion to go into closed session and the Board convenes while in closed session. They never re-enter a full meeting.
4. The majority of the Board business is conducted behind closed doors. No minutes are taken in closed session and there seems to be no evidence that is obtainable through public records requests of the issues handled. Mary James once told me that no one else was allowed in the closed sessions, no notes are taken and she is not invited in.
5. The Board Meeting Minutes that are published are often incorrect and have sometimes been absolutely erroneous. Minutes often state issues that weren't discussed or things that didn't occur. Specifically the 2-8-08 meeting.
6. Committee memberships are anonymous. There has never been a call from the Board for any interested party to join a committee. I am not sure if a "committee" even exists. They say there is a complaint committee who looks at complaints. They have the power to dismiss RLD complaints against people that are regulated by the PI Board. No one knows who is involved. Khalsa and Cassidy were the only two committee members in the "training committee." Again, there was never any offer to be on the committee and no one outside the Board has ever been solicited. I don't know if there are other committees. There are no committee reports in existence.
7. The Board has ignored public pleas at the meetings and has failed to act upon information that they have been personally given at meetings. This is in addition to the RLD complaints being filed appropriately.
8. The Board refuses to talk about complaints in some cases but openly discusses others. The Board has authorized investigations costing taxpayers money in some complaints but does nothing on almost all others. Please see a portion of the Board meeting minutes for 10-5-07 below:
I think this action speaks for itself. If the Board has a problem with someone it will act on complaints. It should also be noted that I had made three previous complaints against George Davis or National Security or other company alias he uses for three previous years. Nothing was ever done with any of my complaints. At the time, I disclosed Mr. Davis's entire client list not just one client. The board didn't care when I complained.
9. The Board or RLD loses documents in licensee's files and commonly fails to act on Public Records Information requests. Please see my complaint with the Attorney General. Others have been denied documents for a span of years.
10. The Board has ordered other investigations and contracted with outside Private Investigators to conduct investigations on licensees and employees of licensees. I have made two previous requests to obtain information that I know to be in existence and it wasn't provided. Specifically, the Board has hired Dr. George Walker to complete investigations. Presumably, state money was used to pay for his fees. I made a public information request and no information was provided. I personally spoke to Dr. Walker during one of this Board sanctioned investigations where he told me that he was acting upon the authority of the Board.
11. The majority of the company owners and employees have no faith in this Board.
