Below, I detailed a very serious complaint and investigation that uncovered fraud, lies, forgery, false notarization, untruthfulness on state license applications and conspiracy. Myself and others made complaints to every state agency that was responsible for these crimes and the violations of license law. I have attempted to follow up with the complaints since December of 2007 and nothing is being done. The state's processing of these complaints is outrageous.
The beginning, December 2006
I made a complaint against a man who provided unlicensed services and collected thousands in violation of the law. Two other people made different complaints to RLD.
I received a receipt from RLD for the claim but it was dismissed without investigation. I notified RLD in advance that I had boxes of evidence that they could have upon request. They never contacted me.
Approximately one month later this man approached a person and asked him to lie about the man's experience so that he could get a state security company license. This person didn't lie. He felt so strongly about being asked to lie he filed a complaint against the man to RLD.
RLD never contacted him, acknowledged the complaint or investigated it.
I found evidence that this man lied on his application to become a security company and that he failed to disclose the RLD that he had previously had his Sheriff's Commission revoked.
I made additional complaints and enclosed evidence to the Superintendent of RLD, Edward Lopez, his Deputy, Paymela Herndon and Governor Bill Richardson. I have delivery confirmations for the packages.
The man was issued a security license and went about doing business. I made a public Information Request to obtain his application file and received it months later after many requests. I noticed that a experience affidavit included in this application appeared to have scratch outs and alterations to it. It was notarized by the man's new business partner. I contacted the person who filled out the form and he reviewed it. He said that he didn't fill it out or sign it in front of a notary. He said that the changes made weren't his changes and they weren't in his handwriting. He felt so strongly about having his statement forged and falsely notarized that he filled out a complaint and an affidavit of his own and mailed it to the Attorney General of New Mexico in December of 2007. Weeks later he received a letter stating that they received his complaint but no one has ever contacted him or investigated the case to his knowledge.
I sent letters attempting to confirm the status of any of the complaints to RLD, the Attorney General and Governor Richardson. I received no reply except from the Attorney General stating that his office had no authority to investigate the man only some of the other issues that I raised in complaints about failure of the Private Investigator's Board to disclosure of information or handle meetings in accordance with the law.
I sent another letter to Governor Richardson in Santa Fe New Mexico. I made contact with a member of his staff in December 2007 and sent information via Fed Ex to Governor Richardson's campaign headquarters in Des Moines Iowa.
I sent an e-mail to Robert Schwartz while he was at RLD. I attempted to follow up with an RLD Investigator, Douglas Frogley, who told me that he didn't see that this man had any complaints in the state computer system. He checked for about five minutes.
I attempted to follow up with Linda Trujillo, Deputy Director of Boards and Commissions 1 1/2 weeks ago.
I haven't received any information about these complaints and as far as I can tell the state has taken no action whatsoever. It has been almost 1 1/2 years since the first complaint and information was submitted to the state. Myself and four other persons have filed written, notarized and valid complaints with the appropriate state agencies. I don't think that the adjudication of these complaints were handled properly or as the law requires. I am forwarding these complaints to the New Mexico State Police tomorrow. Hopefully the case will finally get investigated.
