What the New Mexico Public doesn't know won't hurt them...

I have received many comments cautioning me about giving the public too much information, especially on-line information. It reminded me of an ostrich hiding its head in the sand. The security industry is in big trouble in New Mexico. Citizens are in danger. Seriously. Can you know if your security guard was background checked by the state or know what crimes he might have been convicted of? Does it matter to you?

Larger numbers of New Mexicans are reading this blog and starting to ask questions of me and their elected officials. How did this happen? Can this really be happening? Why doesn't someone do something about this problem? I don't know the answers to these questions and I am just as frustrated as my readers. This blog was created to shine a light on the increasing and unchecked problems of the industry. New Mexicans- stop hiding your head in the sand! E-mail Governor Richardson and ask him to regulate RLD (Regulation and Licensing Division).

In the meantime, all of the unlicensed companies and companies operating illegally are hoping that all of this talk goes away. It is much easier for them to operate and make good profits with less scrutiny from consumers, government, law enforcement, RLD, Private Investigator's Board and me. I think that NM RLD is also hoping that all of this attention goes away for the sake of its reputation. It was much easier to operate under less scrutiny and with a higher level of autonomy before all of this publicity. The New Mexico Private Investigator's Board still isn't answering its phones... The web site lists two numbers. One goes directly to the Board Administrator, Steve Herrera. I left a message yesterday and it is no surprise to me that he hasn't returned my call. The New Mexico Private Investigator's Board definitely hops this blog will go away. The NM PI Board collects hundreds of thousands of dollars in revenue from New Mexico security companies and guards. It provides little service and almost no oversight. I'm sure they feel like they are making a great profit.

Who is your security guard? Really...

I have received e-mails from many people about the problems in our security industry. I mostly receive e-mails from people who wonder who their security guard really is... Let's say that you live in a gated neighborhood where the property management provides guards, an apartment complex because many of these places have guards, Cliff's Amusement Park, Hinkle Family Fun Center, movie theaters, Lovelace Hospital and many more business across town. If you look- you will see security guards everywhere. Some wear guns and other weapons and others don't. Do you feel safe now?

You have a good reason to worry. Thousands of these guards haven't been background checked. How many thousands we don't know because no one knows how many unlicensed companies are operating. How do you find out of the company is even licensed? Call the NM Private Investigator's Board and check. I call constantly and I leave messages that aren't returned. I left one yesterday. So maybe that isn't a good idea.

Are the guards trained to carry the weapons that they have on their belt? Only 7 out of 150 licensed security companies have state required training plans on file with NM RLD in an audit performed a couple of weeks ago. Again this only goes to the licensed companies. Look in the 2008 Albuquerque Yellowpages, Yellowpages.com or a big on-line directory partypop.com and you will find droves of unlicensed security companies. How many guards do they employ? Who knows. A company has to be licensed to submit their guards to NM DPS background checks. Sorry to be redundant. RLD doesn't even set forth the qualifications of a trainer (if there was a training plan on file), but I guess that doesn't matter much because 96% of the licensed companies don't even have a training plan on file. All of this seems pointless. No one is listening anyway. I'm sure the untrained guard learned enough shooting cans with his revolver to protect you and your children if there were a bank robbery. Right?

If you are a person that is considering hiring a security company you should really have a third party check them and their employees out prior to hiring the company.

How about a Felon security company owner? Could it happen? Yes. The state is well aware of this man and his company. He keeps a big ad the the 2008 Albuquerque Yellowpages if you are curious what he looks like. He has many active security contracts so watch out if you see him.

Security companies without Worker's Compensation hits epidemic proportions! New Mexico Security Blog.

I notified the WC Administration, RLD and the News about an additional 11 uninsured security companies. I was shocked to find out that a few of these companies actually have licenses and employ many people but have no worker's compensation insurance. The number of uninsured security companies is approaching 30 for the Albuquerque area and I am afraid that hundreds of employees are working right now and they don't know that they have no insurance.

One of my officers, Johnnie Poncho, was killed in the line of duty. Dozens of my officers get hurt in the line of duty each year and they are treated for their injuries and are paid for time they must take off of work for rehabilitation. Injuries in the security industry are common. Worker's Compensation is a cost of doing business for legitimate security firms. The cost is rising and it is not uncommon for a medium security company to pay $75,000 in yearly premiums for the insurance coverage. The high cost of this insurance may shed some light on why some companies don't purchase it. These same companies can afford to bid lower prices on projects due to lower costs.

I applaud the Worker's Compensation Administration for communicating with me and accepting the investigations that I provided. I was able to verify these companies on the on-line system and later by telephone with Henrietta Martinez, Bureau Chief; just to make sure they didn't have insurance under some other name. Ms. Martinez and I were shocked at the size of the problem in the security industry. Unfortunately, this is just one of the industry's problems. There are still hundreds of unlicensed companies operating across the state with combined thousands of security guard employees that haven't been background checked or trained.

New Mexico Worker's Compensation Administration have sued 60 companies in the last 2 years! New Mexico Security Blog

New Mexico Worker's Compensation Administration commonly pursues legal action companies who are not in compliance with the law.

The Administration has pursued approximately 60 cases in Court in the past two years. The focus is on having the employers who are not in compliance, obtain insurance and pay back premiums or in the alternative- put the company out of business with restraining orders leading to permanent injunctions.

If the Worker's Compensation Administration can do it- why can't RLD step forward and finally take appropriate action against unlicensed, illegal and companies that have lied on state applications?

When will the security laws in New Mexico be enforced? New Mexico Security Blog

When will the laws be enforced? When will RLD figure out that there are hundreds of companies doing business without licensing, insurance, employee background checks, employee licensing and other violations of the law. What about the bad and illegal treatment of security company employees? I have heard that a large company responsible for providing security at one of NM's biggest hospitals is bouncing employee checks and commonly paying its guards weeks late. Those poor employees did the work and they deserve payment. I can only speculate as to if the employees taxes that are being withheld are paid over to the IRS of if other legal obligations are being met.

Who else can we complain to? I have pretty much exhausted the list in New Mexico. It is hard to comprehend that the New Mexico security industry and its regulatory Board has disintegrated to the level of its current state. My opinion is that the system is completely broken and it can't be fixed. I don't see an honest partnership between RLD/state government and our industry to see the changes through that will stop the death of this industry.

Personally, I can tell you that my firm employees over one hundred New Mexico workers. We have a strong business and we plan to continue however, we have made the business decision that our larger efforts will be concentrated outside of New Mexico. The grass is greener kind of idea. Most all other states are not corrupt and they enforce their laws. Companies can concentrate on working their business and not get caught up in the morass that surrounds having to fight for what is right. Personally, I have spent thousands of hours on investigating illegal activity and this blog. If I took the same time promoting my business then I wold be employing more guards right now.

The one bright side to New Mexico Government is the Worker's Compensation Administration. They seem to be on top of complaints. Investigations are underway and I have seen that they pursue companies who are not in compliance, getting restraining orders if necessary. Hopefully, they will continue their good work.

Bad security companies and their bad employees could relocate to a more appropriate setting. New Mexico laws need to be enforced.

Private Security Guards Weaken National Security

NMCOPSS Founder, Walt Beall sent me this article. I think New Mexico should pay particular attention. Our industry is largely unregulated and the laws of the state are mostly not enforced when it comes to security companies.

I know of a few cases where NM RLD has issued licenses to people when they lied on their applications or used false affidavits to certify their experience to get a license. Companies have failed to notify RLD and lied on applications not disclosing Federal Lawsuits, fines and judgement for unpaid wages. This is actually more common that I first thought. Renewal applications have a section where the applicant would disclose these issues if the truth was to be told.

What will the state of New Mexico do? Up until this point, they have allowed companies who used deception to obtain licenses keep them without even as much as a sanction. Is that right? Why has the state not revoked licenses and prosecuted individuals for violations of the law?

Worst yet, the Attorney General Gary King has specifically received a formal complaint from a man who was the victim of fraud, forgery and conspiracy. This man filled out a statement for a man applying for a PPO license. The statement was altered and then later notarized by the suspect's business partner. This "affidavit" was then used to establish the man's experience to get his PPO license. I received a copy of this PPO file and looked at the false notary. There are obvious changes to the original document. Attorney General Gary King has taken no action. The victim has received a letter acknowledging the complaint many months ago but nothing has happened to the suspect, a security company owner. No victim interview by the AG's investigators. Additional complaints have been made to RLD and others but still no action.

Unfortunately, New Mexico is sending a clear message to crooks who want to operate security companies. It isn't the right message.

Private security guards, thousands of whom are hired to protect many of the
nation's most significant buildings and infrastructures, are largely
unprepared for the responsibilities of safeguarding against well-planned
terrorist attacks, according to new findings by the Associated Press.
Before the events of September 11th changed the way America thought about
security, most guards hired to keep an eye on infrastructure were generally
regarded as low-level rent-a-cops, primarily on the lookout for vandals,
common thieves and malicious teenagers. While some guarded targets that were
considered vulnerable even before 9/11 - such as nuclear facilities and
national landmarks - and had better training to reflect that, the majority
of security guards are significantly underpaid and unprepared for their
duties.

Private security guards are hired to protect a large range of facilities
that could be potential terrorist targets. Not only are they the primary
line of defense for hospitals, schools and large city buildings, but they
are also in charge of chemical factories, water reservoirs, communications
and power networks, public transit facilities and nuclear plants, all of
which have been considered vulnerable targets that could cause significant
harm to the population. Yet, unlike the FBI and most police forces, which
are given specific terrorism training and equipment, private security
officers are largely ignored.

According to a new Labor Department survey, the median pay for security
officers in 2006 was a meager $23,620. Unlike government-managed agents
charged with aspects of national security (Coast Guard, National Guard,
local and state police), security officers are employees of private security
firms, which must aggressively compete for contacts, inevitably driving down
the salaries these companies are willing to pay. As a result, the low pay
structure attracts only the least-qualified candidates - those unable to
obtain more lucrative positions, such as with local police.

In addition to poor salaries, many states have considerably lax regulations
for hiring standards. Of the states that keep applicant histories, the AP
found that about 7.3 percent of applicants for private security positions
were rejected, primarily for having criminal backgrounds. While some states
require FBI background checks for guard positions, many states do not
regulate their private security industry at all, such as Alabama, Colorado,
Idaho, Kansas, Kentucky, Mississippi, Missouri, Nebraska, South Dakota and
Wyoming.

Despite the prevalence of unregulated employment standards, many large
security firms have requested more stringent regulations by state
governments. Currently, if a state does not have a law requiring background
checks, companies are blocked from the FBI's fingerprint background system.
Large firms say the system as a whole would benefit from mandatory federal
background check, so that that playing field would be even and companies
could maintain their reputations while staying competitive.
The AP interviewed several veteran and rookie security officers, finding
that most had very little training on what to do in the event that
terrorists attacked their facility, or even an idea of who they could alert.
Some were simply instructed to call the police.

More New Mexico security companies without Worker's Compensation coverage!

I have verified at least ten additional companies providing security service in Albuquerque that don't have insurance. I will wait to publish these results until Tuesday after I have a chance to visit with the New Mexico Worker's Compensation Administration...

These firms all advertise on one of the highest ranked Internet directories. If a prospective client "googles" "Albuquerque Security Company," these are the companies that are displayed.

I had a long talk with one of these companies on the phone. He gave me the names of a number of very large companies that he provides service including a city. He says that he has a lot of employees and he is even licensed by the State of New Mexico. Why doesn't his company have Worker's Compensation Insurance? Why doesn't state RLD check if New Mexico companies have insurance to protect their workers and clients?

Fort Campbell Security Guard Contractor Agrees to Pay Over $269,000 in Back Wages to 469 Workers After U.S. Dept. of Labor Investigation

LOUISVILLE, Ky. --

AKAL Security has agreed to pay $269,954 in back wages to 469 employees working at Fort Campbell, Ky., following an investigation by the U.S. Department of Labor’s Wage and Hour Division.

“The department is committed to ensuring that employers with federal service contracts pay workers according to provisions of the government contract labor standards,” said James Karn, Wage and Hour’s Louisville district director.

AKAL Security, headquartered in Espanola, N.M., has a contract with the U.S. Army to provide security guards at Fort Campbell. The investigation, covering the period July 2004 to July 2006, was conducted under two laws administered by the agency – the Service Contract Act and the Contract Work Hours Safety Standards Act.

The investigation revealed that AKAL failed to compensate guards for the time required to pick up their weapons and report to assigned duty posts. Also, because the time was not recorded, overtime hours were not calculated correctly.

Under the Service Contract Act, contractors with federal service contracts over $2,500 must pay their service workers no less than the wages and fringe benefits prevailing in the locality. The Labor Department issues wage determinations that provide the required wage rate and fringe benefits for each service occupation. These determinations are incorporated into covered federal contracts.

The Contract Work Hours and Safety Standards Act requires that laborers and mechanics employed on certain federally-funded contracts be paid one-and-one-half times their regular rate of pay for all hours worked over 40 in a single workweek. Employers must also maintain accurate records of employees’ wages, hours and other conditions of employment.

U.S. Labor Department Recovers $102,831 in Back Pay for Security Guard Workers in Albuquerque

ALBUQUERQUE, N.M. -- Mesa Detection Agency Inc. in Albuquerque has agreed to pay $102,831 in back wages after an investigation by the U.S. Department of Labor’s Wage and Hour Division found that 177 current and former security guards had not been paid properly.

“Employees are entitled to the wages they have earned,” said Cynthia Watson, Wage and Hour regional administrator in Dallas. “The company failed to pay overtime for hours worked over 40. This is illegal.”

The investigation, covering the period Sept. 19, 2004 to Aug. 31, 2006, found that the company paid straight time for all hours worked and made improper deductions, reducing employee pay below the minimum wage, violating the provisions of the Fair Labor Standards Act (FLSA).

The FLSA requires covered employees to be paid the minimum wage of $5.15 for all hours worked and time-and-one-half their regular rate of pay for hours worked over 40 per week. Employers must also maintain accurate time and payroll records.

Mesa Detection Agency, which provides security services to downtown locations, cooperated with the investigation and has agreed to comply with the FLSA in the future. Back wages will be paid in full by December 2006.

The Wage and Hour Division concluded 34,858 compliance actions in fiscal year 2005 and recovered more than $166 million in back wages for more than 241,000 employees. Back-wage collections last year represent a 26 percent increase over back wages collected in fiscal year 2001. The number of workers receiving back wages has increased by 11 percent since fiscal year 2001.

Private Security protects 85% of America's infrastructure!

I received this e-mail/link from NM COPSS founder Walt Beall. If you are involved in the security industry- please read it.

In 2005, a document at the U.S. Department of Justice entitled “Engaging the
Private Sector To Promote Homeland Security: Law Enforcement-Private
Security Partnerships.” It states the private sector protects about 85
percent of the nation’s infrastructure, and recommends law enforcement work
collaboratively with private security as neither possesses the total
resources to prevent terrorism and terror related acts. This partnership is
viewed as critical in protecting our country.

New Mexico Private Investigator's Board is still hiding evidence, not hearing complaints and not obeying the law.

I make a lot of complaints about companies doing bad things in our industry. Breaking laws. The law says that I have to forward complaints to NM RLD. I do and I get delivery confirmations. Year after year, they lose complaints, don't respond to most of them, dismiss a few in closed session and they don't follow New Mexico law in processing the complaints.

The new PI Board staff, RLD Superintendent and Deputy came to us and said that they were going to look into the Board's past problems and non-responsiveness and work honestly to solve our problems. They told me that they would finally review all of my complaints and take appropriate action if the complaints had not been heard, received or prosecuted. Many involved felony violations of law.

I re-sent the complaints and additional information to many members of government. I finally got an answer to e-mails and messages by Steve Herrera, new PI Board Administrator. Here are the e-mails that he sent to me along with my response. It is plainly obvious to me and other industry leaders, employees and victims that RLD is up to its same old tricks. Beware- security industry in New Mexico!

I guess you are playing games. You are missing many complaints and you know it. I have made eight complaints this year alone. In fact, I have made a good number of complaints every year since 2000. Dozens and dozens of complaints over the years. I have delivery confirmations for many, many complaints that I have sent to Ed Lopez when he was Superintendent, his Deputy Paymela Herndon, Deputy Linda Trujillo, the Attorney General and Governor Bill Richardson. Those complaints were not listed here.

I hoped that you might be an honest partner in handling the problems and corruption in RLD and at the New Mexico Private Investigator's Board. I am certain that you are not working towards an honest end to mine and the security industry's complaints.

I will pursue other avenues. Shame on you for taking a government position and not working for the People. Hopefully, you didn't take an Oath of Office.

I researched the 2008 Albuquerque Yellow Pages and the Yellow Pages.com online directory for security companies. The following companies were listed under "security services" advertising for security clients but I verified and posted the results from the New Mexico Worker's Compensation web site confirming that these companies have no worker's compensation insurance. It appears through the verification through the NM Worker's Compensation verification system that these companies may not have insurance. Consider your liability carefully...

To the New Mexico Private Investigator's Board and NM RLD... Shame on you for not checking your own state web site to protect New Mexico's workers. As usual, this information was on a state run web site and easy to find. Please note that many of the companies that I have made complaints about for years are on this list.
